Medical Negligence — Orthopaedics Ms. Anna Hegarty, Secretary of the Litigation Committee of Law Society, Blackhall Place, Dublin 7. Dear Miss Hegarty, I would like to inform the Law Society that procedures have been laid down by the Irish Institute of Orthopaedic Surgeons with regard to cases of alleged medical negligence. Those procedures were formulated at the Annual General Meeting in 1985 and have remained unchanged since. (The vast majority of Orthopaedic Surgeons in the Republic of Ireland are members of the Irish Institute of Orthopaedic Surgeons). There is general agreement among the Institute Members that they should take on those cases when requested to do so. A Solicitor may approach any mem- ber of the Institute asking him to act on behalf of his client. The Orthopaedic Surgeon in accepting the case will nominate a colleague who will examine the patient with him and both Surgeons will then issue a joint report. A fee for this examination and report will be agreed between the Solicitor and the first Surgeon to be contacted. If the Litigation Committee requires any further information or if that Committee wishes to meet members of the Institute, appropri- ate arrangements can be made. Kind regards. Yours sincerely, Mr. Joseph P. McGrath, M.Ch., M.CH.Orth., F.R.C.S.E., F.R.C.S.I., Chairman, Irish Institute of Orthopaedic Surgeons. 20th February, 1989

Court List Numbers Under the existing arrangement a plaintiff's solicitor must set down an action for trial within fourteen days after the service of the notice of trial. The Litigation Committee recom- mends that within seven days of the setting down of an action the plaintiff's solicitor should inform the defendant's solicitor of the list number. • Litigation Committee Lloyd's Underwriters This note is supplemental to the Note published in the December 1988 issue.
