on the stated grounds that lie was entitled to payment in respect of one successful unit only, refused to pay him the full amount appropriate to two units. The Racing Board denied that all of the rules governing multiple event pools or jackpots were set out in the claim; and denied that Mr. Duff in the Jackpot Combination ticket had purchased selected horse No. 1 in the sixth race twice, as alleged or at all. It was alleged that Mr. Duff did not inform the person from whom he purchased the combination ticket of the num- ber of horses in any of the races he wished to combine. Judge's Comments The Board also submitted that it was provided by the rules that in the event of any dispute or difference in relation to the jackpot, it should lie determined by the Totalisator Manager and that his decision should he binding on all parties. It was submitted that Mr. Duff had not submitted the claim to the Manager. In his judgment, Mr. Justice Pringle said that, in his opinion, Mr. Duff was entitled to he paid for two units and not for one. There was nothing explicit 011 the ticket or in the rules to show that, if a purchaser wanted to nominate a horse twice in any race, he must insert the number of that horse twice, or that it was not sufficient for him to indicate under the heading "Total

Selections" at the foot of a column for any race in which he had only nominated one horse to win, that he was nominating that horse twice by inserting the figure "2". "Complied with Rules" He did not consider that the particular rule was a sufficient indication that, if only one horse was being nominated in a race and the punter desired to nominate that horse twice, he must insert its number twice. Mr. Justice Pringle said that if this was a necessary requirement in the completion of a ticket, he thought it should have been clearly provided for in the rules, which was not done. He considered that a purchaser who decided to nominate only one horse to win a particular race hut who desired to nominate that horse twice, could comply with the rules in either of two ways—either by inserting the number of the horse twice under the heading "horse numbers", or by only inserting the horse's number once under that heading, hut by inserting the figure "2" at the bottom of the column for the race in question under the heading "Total Selections". He said that the latter course was the one which Mr. Duff adopted and, in his opinion complied with the rules.
