JUDGE OR JURY? The Jury Trial for Personal Injury Cases in Ireland. Bryan M. E. McMahon. At present persons injured in motor accidents or in accidents at work are entitled to a jury trial when they seek compensation for serious injuries. It has been suggested that large jury awards have contributed to recent crises in the insurance industry. The call has gone out for the abolition of the jury trial in civil actions. The Government has indicated that it intends to do so in the near future. In this pamphlet the author argues that there is little evidence to justify the abolition of the jury in such cases and suggests that isolated tampering with the jury trial is unwarranted: the Government should not be stampeded into precipitated action which threatens a legal institution of proven value.
