value of the premises, good will and fixtures but not on the value of the moveable chattels. Any work done in connection with the sale of the moveable property is chargeable under Schedule 2. Sale of Registered Land — Costs The Council stated that on a sale of registered land to which rule 33 of the land registration rules 1966 applies the commission scale is charge– able if the register declines to convert the posses– sory title into an absolute title on the short pro– cedure and if the solicitor for the purchaser has to undertake any work in connection with the matter. Solicitor — Candidate in Local Elections The Council stated that (a) there is no objection to the use of the professional description of a solicitor on election literature, (b) that there is no objection to the use of offices for election purposes provided that election posters or litera– ture are not displayed on the premises. 27th July 1967: The President in the chair, also present : Desmond Collins, Ralph J. Personal Undertaking Member acted for the owner of property which was sold. After the date of the contract and before completion member on the authority of the client gave an undertaking to a creditor that their debt would be discharged from the proceeds of sale. The client died before completion and his estate is insolvent. Member had also written to other creditors advising them of the position and stated that as soon as the Grant of Probate had been received they would be notified of the composition they would receive on foot of their claims. The executor of the will has directed member to disregard the undertaking given so that the smaller creditors can receive a larger dividend. Members enquire as to their professional position. The Council stated that the members are bound by the personal undertaking given to the principal creditor. Members position with regard to the clients money in their hands is a question upon which they are advised to take counsel's opinion.
