(Gross Sum) Order 1934 (under which a gross or lump sum could be charged in lieu of detailed charges) and did not expressly enact that a gross sum could be charged or that a lump sum bill could be delivered. (ii) The scope o f non-contentious business to which art. 2 ( c ) o f the Solicitors’ Remuneration Order, 1883, applied was limited by the words ‘ and not being otherwise contentious business ’ in s. 2 o f the Solicitors Remuneration Act, 1881, under which the order was made, although those words did not appear in art. 2 (c) o f the order, nor in the definition of non-contentious business in s. 81 (1) o f the Solicitors Act, 1932, which had repealed and superseded the Act o f 1881 but contained savings under which the order o f 1883 continued to have effect; and (iii) As the business to which the lump sum bill related was in part contentious, because it comprised the collection of information and the taking of all steps, even to the engrossment o f a petition for judicial separation, necessary to launch proceedings against the husband, the delivery o f a lump sum bill was not justified in the present case by the provisions to Sch. 2 as amended, and accordingly the client was entitled to an itemised bill. The result o f the present case in its application to Ireland is that, if business is wholly non-conten­ tious, a lump sum bill may be delivered under the provisions o f the corresponding S.R.G.O. (No. 2) 1920 complying with the terms o f that order. If the business is contentious section 4 o f the Attorneys and Solicitors Act, 1870, applies and the solicitor must establish an agreement under and general compliance with that section.
