P r a c t it io n e r s who are not solicitors to local authorities or to State subsidized Boards will welcome this measure which will remedy what had been a manifest injustice to many litigants. It will be recalled that under the Public Authorities Protection Act, 1893, which was passed “ for the protection of persons acting in the execution of statutory and other public duties ” , that no action or proceeding could be instituted against such bodies, unless it was commenced within six months next after the act, neglect or default complained of, or in the case of the continuance o f injury or damage, within six months next after the ceasing thereof. The position had, to a certain extent, been remedied in England last June by the passing o f the Law Reform (Limitation o f Actions) Act, 1954 which repealed the Public Authorities Protection Act, 1893, and which increased to three years the period in which personal injury actions could be taken against a public authority or a statutory body, and also by dependants under Lord Campbell’s A c t ; further more, the said Act was to bind the Crown, and could thus be made applicable in actions against Depart ments o f State. The Irish Public Authorities (Judicial Proceedings) Act, 1934 is correspondingly wider than its English counterpart; for it repeals completely the Act of 1893, and all Schedules under that Act, as well as Section 44 of the Great Northern Act, 1953, which had limited the period in which proceedings could be taken against the new Great Northern Board to 61
