THE attention of solicitors is called to Sections 7-15 of the above Statute, which contain provisions which may require consideration by solicitors advising vendors and purchasers of house property. By Section 2. the expression " habitable house " means a house situate in the functional area of a housing authority which, in the opinion of such authority, is reasonably fit for human habitation or is reasonably capable of being rendered so fit. The joint effect of Sections 7 and 8 of the Act is to prevent any person from demolishing in whole or in part or using otherwise than as a dwelling- house any habitable house, without the permission of the housing authority in whose functional area the house is situated. An appeal from refusal of this permission lies to the Minister for Local Govern ment. Section u, which will come into operation on ist July, 1948, prohibits any person from permitting premises to be used as a multiple dwelling without permission in writing of the housing authority in whose functional area the premises are situated.. Such permission shall not be unreasonably withheld and an appeal from the refusal of permission lies to the Circuit Court within one month after receiving notice of such refusal. Solicitors acting for pur chasers of premises who intend to use them either as business premises or for letting purposes would need to consider carefully the effect of Part II of the Act.
