alter the whole thing. Whatever the reason, the Local Government Board did publish a new Order, in which they expressly provided that a tenant from year to year, whether holding under a statutory tenancy or other wise, was not to be considered an owner or lessee for the purposes of the scale of fees they fixed. That Order was published on the 6th of October of the present year. That being so, could that new Order be now used to cut down Mr. Gallagher's fees in respect of the abstracts he had furnished on behalf of tenants from year to year, long before the Order. Having fully considered all the facts, His Honor held that Mr. Gallagher was right. Accordingly, in these cases a decree for two guineas in each case would be given. Mr. Boyle said he had been instructed by the Local Government Board to appeal if the decision was adverse to his contention. He would, therefore, ask that a decree be given in one case and that the others be withheld. Judgment was entered accordingly for the plaintiffs in this one case, and the others were adjourned pending appeal.
